Terms and Conditions.

Please read these Terms & Conditions carefully. By booking, making payment, signing digitally or physically, or taking possession of the vehicle, the renter agrees to be legally bound by the terms stated below.

1. Booking, Payment & No‑Refund Policy

  • Full rental payment must be made in advance to confirm the booking.
  • All payments are strictly non‑refundable, under any circumstances.
  • Once confirmed, bookings cannot be cancelled, rescheduled, transferred, or modified.
  • Early return of the vehicle shall not entitle the renter to any refund, credit, or adjustment.
  • Payment of the rental amount shall be deemed as final acceptance of these Terms & Conditions.

2. Eligibility & Documents

  • The renter must possess a valid Indian two‑wheeler driving licence appropriate for the rented vehicle.
  • Minimum age requirement:
    • 18 years for Scooters
  • A government‑issued photo ID (Aadhaar / Passport / Voter ID) must be submitted along with the driving licence.
  • Licence and identity verification is mandatory prior to vehicle handover.
  • Only the registered renter is permitted to operate the vehicle.
  • Wearing a helmet is compulsory at all times while riding. Extra helmet is not required for travel within Udupi (pillion rider).
    However, if you are travelling to Mangalore, an extra helmet for the pillion rider is compulsory as per traffic rules.
  • Extra helmet can be provided at a charge of ₹50.

3. Rental Duration, Pickup & Drop‑off

  • Pickup and drop‑off shall strictly adhere to the confirmed booking date, time, and location.
  • Return Location: The vehicle must be returned to the same location from which it was picked up, unless prior written approval is obtained from Udupi Bike Rental.
  • Unauthorized drop‑off at a different location may attract additional recovery or transportation charges and may be treated as a breach of contract.
  • A 15‑minute grace period is allowed at the time of drop‑off.
  • Any delay beyond the grace period shall result in full‑day rental charges, with no hourly or partial‑day calculation.

4. Kilometer Usage

  • Kilometer limits shall be as specified in the booking confirmation.
  • Excess kilometer charges:
    • Scooters: ₹5 per km
  • Excess kilometer charges must be settled at the time of vehicle return.

5. Fuel Policy

  • Fuel is the sole responsibility of the renter.
  • The vehicle must be returned with the same fuel level as recorded at the time of pickup.
  • Any excess fuel remaining in the vehicle at the time of return will not be refunded, either in cash or in kind.

6. Helmet, Key & Accessory Charges

  • One helmet is provided with each booking.
  • Additional helmets are available at ₹50 per day per helmet, subject to availability.
  • Loss or damage of helmet: ₹1,000 per helmet.
  • Loss of vehicle key: ₹1,000 charge.
  • Loss or damage to mirrors, indicators, phone holders, documents, or any other accessories shall be charged at actual replacement cost.

7. Vehicle Condition & Cleanliness

  • Vehicle condition shall be documented through photos/videos recorded by Udupi Bike Rental staff at the time of pickup and drop‑off. The renter expressly agrees to and accepts the photos/videos recorded by Udupi Bike Rental as valid evidence of the vehicle’s condition at the time of handover and return.
  • The renter must inspect the vehicle prior to accepting delivery.
  • The vehicle must be returned in the same condition as handed over, excluding normal wear and tear.
  • If the vehicle is returned excessively dirty or muddy, a cleaning charge of up to ₹200 may be levied.
  • Unauthorized modifications, sticker application, number plate alteration, or repairs are strictly prohibited and shall attract a ₹2,000 penalty, in addition to restoration costs.

8. Damage, Loss & Accident Policy

  • The renter shall be fully responsible for any damage, loss, or theft of the vehicle or its parts during the rental period, irrespective of fault.
  • Repair or replacement costs shall be determined based on authorized service‑centre estimates or prevailing market value.
  • In the event of an accident, fall, or collision:
    • Full repair costs shall be borne by the renter.
    • Towing, recovery, or impound charges shall be borne by the renter.
    • All vehicles are covered under third-party insurance only. This insurance does not cover any damages to the rented scooter. Any such damages
      will be the responsibility of the renter. 
    • The period during which the vehicle remains under repair shall be charged at 50% of the daily rental amount.

9. Mechanical Issues & Maintenance

  • The renter is responsible for monitoring engine oil levels and basic vehicle care, especially during extended trips.
  • Any mechanical or technical issue must be reported to Udupi Bike Rental immediately.
  • Mechanical failures resulting from misuse, negligence, or improper riding shall be chargeable to the renter.
  • Genuine mechanical failures not attributable to renter negligence shall be handled by Udupi Bike Rental.

10. Traffic Violations, Speed & GPS

  • The renter is solely responsible for all traffic violations, fines, penalties, challans, tolls, and legal consequences arising during the rental period.
  • All vehicles may be equipped with GPS tracking systems.
  • Riders must comply with company‑specified speed limits or statutory speed limits, whichever is lower.
  • Overspeeding, rash riding, or repeated violations may result in penalties or immediate termination of the rental without refund.

11. Prohibited Use

The vehicle must not be used:

  • Under the influence of alcohol, drugs, or prohibited medication
  • For racing, stunts, rallies, competitions, or commercial purposes
  • For any illegal or criminal activity
  • By any person other than the registered renter

Udupi Bike Rental reserves the right to terminate the rental immediately without refund and repossess the vehicle in case of any violation.

12. Insurance & Limitation of Liability

  •  All vehicles are covered under third-party insurance only. This insurance
    does not cover any damages to the rented scooter. Any such damages will be the responsibility of the renter. 
  • Personal injury, medical expenses, rider negligence, or third‑party liabilities are the sole responsibility of the renter.
  • Udupi Bike Rental shall not be liable for any loss, injury, or death except where such liability cannot be excluded under applicable law.

13. Indemnity

The renter agrees to indemnify, defend, and hold harmless Udupi Bike Rental, its owners, employees, and agents from any claims, losses, damages, penalties, liabilities, or legal expenses arising out of the renter’s use or misuse of the vehicle.

14. Force Majeure

Udupi Bike Rental shall not be held liable for any delay or failure in performance resulting from events beyond its reasonable control, including but not limited to natural disasters, strikes, government restrictions, road closures, or other unforeseen circumstances.

15. Severability

If any provision of these Terms & Conditions is held to be invalid or unenforceable, the remaining provisions shall continue to remain in full force and effect.

16. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts of Udupi, Karnataka.

17. Additional Important Conditions

  • Security Deposit (if applicable): Any security deposit collected may be adjusted against damages, fines, excess kilometres, or other dues. Any balance, if applicable, shall be refunded after inspection.
  • Police Seizure or Legal Issues: If the vehicle is seized or detained due to the renter’s actions, all associated costs, fines, legal expenses, and loss of rental days shall be borne by the renter.
  • Sub‑leasing Prohibited: The vehicle shall not be sub‑rented, lent, or handed over to any third party under any circumstances.
  • Smoking & Abuse: Smoking, carrying flammable materials, or abusive use of the vehicle is strictly prohibited and may attract cleaning or repair charges.
  • Emergency Reporting: In the event of an accident, breakdown, or legal issue, the renter must immediately inform Udupi Bike Rental and the relevant authorities.

18. Final Acceptance

By booking, making payment, signing digitally or physically, or taking possession of the vehicle, the renter confirms that they have read, understood, and agreed to these Terms & Conditions.
